TERMS AND CONDITIONS
GENERAL CONDITIONS FOR PARTICIPATION:
The present general conditions of participation are complemented by the particular conditions of participation that may appear in the program of each activity.
1. REGISTRATION
1.1 Registration is carried out by completing and submitting the Registration Form found on this website, duly completed.
1.2. With the registration the client:
1.2.1. Assumes the obligation to acknowledge and accept the present general conditions of participation, as well as the particular conditions contained in the program in which it is registered;
1.2.2. He assumes that he is in adequate health conditions for the activity in which he subscribes and accepts the possibility of taking all the risks inherent to his own nature;
1.2.3. He is aware of the type of physical, cultural and psychological demands that these activities involve, including personal and material damages, illnesses, setbacks and discomfort and accepts them; and also accepts that they may produce unforeseen events.
2. RESERVATION CONDITIONS
Reservation confirmation in the programs is carried out in chronological order of receipt of the duly completed Registration Form and respective payment of the deposit.
Our programs have a limited number of participants.
3. PRICES
Activity prices may change without notice due to the variation in prices of service providers, fuels, fees or taxes. Whenever there is a price change, the customer will be informed and will be able to maintain or cancel their subscription.
4. WITHDRAWALS AND REIMBURSEMENT
If the client wants to give up this activity, he must do so in writing or by email.
5. IMPOSSIBILITY OF COMPLIANCE
If circumstances not attributable to Andar a Monte determine the cancellation of the activity, the customer can choose to be reimbursed of all amounts paid or to change his enrollment to another activity of equivalent price. If the activity chosen is of a lower or higher price, the customer will be refunded or must pay the difference, respectively. If the minimum number of participants indicated in the program of the chosen activity is not met, Andar a Monte may:
1. Maintain the performance of the activity with a reduced number of participants by paying a supplement, in which case the informed client can maintain or cancel his registration without any penalty
2. Choose to cancel the activity up to 15 days before the start date, reimbursing the customer of all amounts paid, without any other type of responsibility on the part of Andar a Monte for termination.
6. SCHEDULE
The client must respect the stipulated times for the start of activities. Delays may mean that it is impossible to carry out part of the activity.
7. CHANGES
In order to ensure greater safety and quality in the performance of activities, Andar a Monte reserves the right to change the time, place and structure of said activity if there are weather conditions, or others, external to the company, which require it.
8. DEGREE OF DIFFICULTY
It is the client’s responsibility to check the degree of difficulty of the program in which he / she enrolls and if it is suitable for his / her abilities. Andar a Monte clarifies all doubts and questions during the registration process but cannot be held responsible for the fact that the participant does not have the physical conditions or aptitudes for the correct performance of the activity.
9. SECURITY
We always have as a priority the safety of all the people involved in our activities, customers, guides or whoever collaborates in the organization of the activity. The equipment of Andar a Monte used in the activities is approved and whenever the activity requires it, specific personal protective equipment is provided;
In guided activities, Andar a Monte monitors, in addition to guiding the group, assume the responsibility of making decisions in the field whenever unforeseen events occur. At least one of the guides has first aid training. The client of a guided tour must respect the guide’s decisions and directions.
10. INSURANCE
Policy No. 2399689 and No. 02399812 of the insurance company CA Seguros, SA. Civil Liability: 50,000.00 euros. Personal accidents: Death or permanent disability: 20,000.00 euros; Treatment and repatriation expenses – 3,500.00 euros. All luggage, equipment and personal belongings will be under the responsibility of the customer. Andar a Monte is not responsible for any loss, damage or accident to any baggage or equipment, regardless of how it occurs.
11. PERSONAL REQUIREMENTS
Our mission is to provide you with the best experience, so we will do everything to satisfy any special needs, such as vegetarian food. Just inform us as early as possible.
12. EQUIPMENT REQUIRED
Specific equipment is usually included in the activity. For details on the necessary / recommended equipment, consult the activity information.
13. USE OF PHOTOGRAPHS AND IMAGES
Any image of the customer, captured by Andar a Monte monitors or employees in any of our activities, can be used by Andar a Monte, in the illustration of the company’s promotional and advertising material such as catalogs, slides, videos and the Internet. In photos where people are clearly identified, they are not marketed or made available for other purposes.
14. COMPLAINTS:
Complaints are considered to be those submitted in writing to Andar a Monte within a period not exceeding 15 days after the end of the provision of services.
Any conflict arising from this service provision contract will be settled by the Judicial Court of the District of Évora with express waiver of any other and for all matters not regulated by these General Conditions of Participation, Portuguese Law will apply.
15. ALTERNATIVE RESOLUTION OF CONSUMPTION DISPUTES:
Under Law No. 144/2015 of 8 September, the Client may use the following Alternative Dispute Resolution Entities: Provedor do Cliente das Agências de Viagens e Turismo in www.provedorapavt.com; Comissão Arbitral do Turismo de Portugal in www.turismodeportugal.pt; or to any of the entities duly indicated in the list provided by the General Directorate of Consumers in http://www.consumidor.pt whose consultation we advise.
